A Third Country Visa is for foreign nationals in the US who are applying for a nonimmigrant visa at a US consular post in a third country such as Canada, Mexico, or Bermuda. The Third Country Visa is a visa application or visa acquired is from a US Consulate in a country other than the alien's home country.
Individuals who have remained in the US longer than the time period allowed by the immigration officer when entering the US with any type of visa, must apply in the country of their nationality or legal permanent residence, and thus cannot apply at a border post.
