J-1 Advisory Opinion

An advisory opinion is a request for a statement from the State Department's Waiver Review Division as to whether someone in J-1 status is subject to the home residency requirement under Section 212(e) of the Immigration and Nationality Act. An advisory opinion is sought out when there is doubt as to whether a J-1 participant is subject or not subject to Section 212(e).

If a J-1 visa holder is unsure, it is recommended that he or she obtain an advisory opinion from the Waiver Review Division. To obtain an advisory opinion, the individual should mail all legible copies of all of their DSP/IAP-66 forms along with the written request for an advisory opinion to the U.S. Department of State.
